Broker Data Processing Agreement
The written instruction under which Dailify processes lead data on a broker's behalf, as required by section 21 of the Protection of Personal Information Act.
The wording below states the arrangement Dailify already operates under and which the Privacy Policy describes. It has not yet been settled with legal counsel, and it will be replaced by a final version. Brokers who accepted at signup will be asked to accept the final wording when it is published, and both acceptances are kept.
1. Who is who
You — the brokerage — are the responsible party for the personal information of the people you ask us to contact. You decide who is called, why, and on what lawful basis.
Dailify, operated by Ghost AI, is your operator. We process that information only on your documented instruction, which is what this agreement is.
2. What we process, and why
Contact details and the demographic fields you supply or select, for the sole purpose of placing consented outbound calls and booking appointments into your calendar. We do not use your lead data to train models, and we do not disclose it to other brokerages.
3. Consent is yours to establish
You warrant that every lead you upload carries a lawful basis for direct marketing contact, and that you can produce the consent record for it. Leads without a provable basis are quarantined and never dialled.
4. Security and sub-operators
Data is held in South Africa. Access is restricted to what is needed to run the service and is audit-logged. We use sub-operators for telephony, speech processing, messaging and hosting; each is bound to equivalent terms, and the current list is available on request.
5. Retention and deletion
Recordings and transcripts are retained for 180 days by default and then anonymised. Consent and opt-out records are kept longer, as compliance evidence. You may request export or deletion of a data subject's records at any time, and we act within the statutory period.
6. Opt-outs
An opt-out given on any call is honoured immediately and applies across the whole platform, not only to your campaigns. You cannot instruct us to call a number that has opted out.
7. Ending the arrangement
On termination we return or delete your lead data on request, retaining only what the law requires us to keep.
