Terms of Service
These terms govern your use of Dailify. By creating an account you agree to them.
What Dailify does
Dailify places outbound calls to prospects you supply, qualifies them against criteria you set, and books appointments into your connected calendar. An AI assistant conducts the call; you conduct the advice.
Who may use it
Dailify is for licensed South African financial services providers and their authorised representatives. You confirm that you hold a current FSP licence, that the number you give us is yours, and that you are authorised to bind the brokerage you register.
What you are responsible for
- The lawfulness of your leads. You may only upload contacts you have a lawful basis to call. You supply the source, the wording consented to, the channel and the date for each one, and you confirm those are accurate.
- Your script. Scripts are submitted for review and must be approved before dialling. Approval is a check that the script carries its required disclosures; it is not legal or compliance advice, and it does not transfer responsibility for the content to us.
- Your licence and disclosures. The FSP number and brokerage name the assistant states on a call are the ones you gave us.
- Account security. Keep credentials confidential and tell us promptly of any unauthorised use.
What we are responsible for
- Disclosing on every call that it is recorded, on whose behalf it is made and why, before anything else is discussed โ and that the caller is an AI assistant whenever the person asks.
- Screening every number against your own suppression list, and against every opt-out recorded anywhere on the platform, before dialling. Registration with the National Consumer Commission is in progress; screening against its registry begins once that completes.
- Honouring an opt-out immediately and permanently.
- Calling only inside the hours you set, and never outside the hours the law permits.
- Keeping a recording, a transcript and a verification trail for every appointment we charge you for.
What you pay for
You pay for verified appointments. You do not pay for dials, for connected calls, for conversations, or for appointments that fail verification.
What "verified" means
An appointment is charged only when it reaches confirmed_ready โ that is, when it has
passed automated checks on the call, an assessment of the transcript, and confirmation from the
client. The charge is the state transition; nothing is deducted before it.
Credits and top-ups
- Credits are bought in advance and drawn down as appointments are verified.
- Prices are in South African rand and include VAT where applicable.
- Unused credits do not expire while your account is open.
- Credits are not refundable for change of mind, but see disputes below.
Disputes
If you believe an appointment was charged wrongly, raise it in the portal within 14 days. We review the recording and the verification trail. If the appointment did not meet the standard, the credit is returned in full.
Calendars
Connecting a calendar is optional and can be withdrawn at any time. What we read and write is set out in the Privacy Policy, and is limited to busy times and to the meetings we book. If a connection expires or is revoked, affected campaigns pause rather than book into a calendar we can no longer read.
The assistant
Dailify includes an assistant — Kea — on the website and inside the portal. What you type to her is kept for 180 days, the same period we keep a call recording, and then deleted. Ask us and we will delete it sooner.
We read it. Our staff may review what is put to the assistant for two purposes: to find anything that could place your brokerage, or us, in breach of the FAIS Act, the POPI Act, the Consumer Protection Act or the conditions of your licence; and to find faults and suggestions worth acting on. We do it to keep the platform lawful and to make it better, and for nothing else — not to assess your performance and not to market to you.
She cannot see your account. She is told which screen you are on and answers from our published material; she has no access to your appointments, your leads, your wallet or your clients.
Do not type client information into her. Nothing about her needs it, and a question is not the place for somebody else’s personal information.
Acceptable use
You may not use Dailify to call people who have not consented, to market anything other than the financial products your licence covers, to impersonate another person or firm, or in any way that breaches South African law. We may suspend an account immediately where we reasonably believe it is being used unlawfully.
Availability
We aim to keep Dailify available continuously but do not guarantee uninterrupted service. Maintenance is scheduled outside calling hours where possible.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act. Subject to that, our total liability in any twelve-month period is limited to the amount you paid us in that period, and we are not liable for indirect or consequential loss, including lost profits or lost business opportunity.
Ending the agreement
You may close your account at any time. We may end the agreement on 30 days' notice, or immediately for unlawful use or non-payment. On closure we stop calling, and handle your data as set out in the Privacy Policy.
Changes
We may change these terms. Where a change is material we will tell account holders by email at least 14 days before it takes effect.
Law
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
